• Infringes on the intellectual property rights of any third party.
• Contains nudity, graphic violence, or sexually explicit material.
• Promotes hate speech, discrimination, or harm based on race, ethnicity, religion, gender, sexual orientation, or disability.
• Contains malware, viruses, or any other harmful code.
• Impersonates another person or entity.
• Constitutes spam or unsolicited advertising.

We reserve the right to remove any content that violates these guidelines without notice.

5. Content You Contribute

You are solely responsible for all content you contribute to MyGifMaker ("User Content") and, as between you and MyGifMaker, you own your User Content. By contributing User Content, you hereby grant MyGifMaker a non-exclusive, worldwide, perpetual, royalty-free, fully paid, transferable, and sublicensable right to use, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit such User Content, including all related intellectual property rights in connection with the platform and our business.

You represent and warrant that you have all rights necessary to grant the above licence without infringing or violating any third-party rights, including copyright, trademark, privacy, or any other intellectual property or proprietary right.

If you contribute User Content to a public part of MyGifMaker, such as the community GIF gallery or your public profile, you acknowledge that such content will be visible and accessible to all visitors, including users who are not registered. Please do not publicly post any User Content that you do not have the right to share, or that contains private, sensitive, or confidential information you do not wish to be publicly viewable.

In a nutshell: You own everything you upload to MyGifMaker, but you're giving us permission to display and use it as part of running the platform. Anything you post publicly is public. So only share what you're comfortable with the world seeing.

6. Intellectual Property

You retain ownership of the content you upload to MyGifMaker. By uploading content, you grant MyGifMaker a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote your content on the platform.

You represent and warrant that you own or have the necessary rights to the content you upload and that it does not infringe any third-party rights.

The MyGifMaker name, logo, and platform design are the intellectual property of MyGifMaker. You may not use them without our prior written permission.

7. GIF Tools

MyGifMaker provides tools for creating, converting, resizing, optimizing, and editing GIFs. These tools are provided for personal and non-commercial use. You are responsible for ensuring that any files you process through our tools comply with applicable copyright laws.

Processed files are stored temporarily and automatically deleted after a short period. We are not responsible for any loss of processed files.

8. Prohibited Conduct

You agree not to:

• Use MyGifMaker for any unlawful purpose or in violation of these terms.
• Attempt to gain unauthorized access to any part of the platform or its systems.
• Scrape, crawl, or systematically download content from the platform.
• Interfere with or disrupt the platform's servers or networks.
• Use automated bots or scripts to interact with the platform.
• Attempt to reverse engineer any part of the platform.

9. Disclaimers

MyGifMaker is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the platform will be available at all times, error-free, or secure.

We are not responsible for any content uploaded by users and do not endorse any user-generated content.

10. Limitation of Liability

To the fullest extent permitted by law, MyGifMaker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of profits, or damage to reputation.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

Upon termination, your right to use the platform will immediately cease. Content you have uploaded may be removed at our discretion.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms shall be resolved through good-faith negotiation before pursuing any formal legal remedy.
